IPA CIS Working Group Reviews New Proposals for the Model Law on Cross-Border Insolvency
The working group of the Inter-Parliamentary Assembly of the Commonwealth of Independent States, tasked with drafting the model law "On Cross-Border Insolvency and Bankruptcy", has continued its work. The group's latest meeting took place on 18 September.
The parliaments of the Republic of Belarus, Kazakhstan and Kyrgyzstan, as well as committees of the Federal Assembly of the Russian Federation, submitted proposals for the meeting of the working group on refining the draft model law.
The General Confederation of Trade Unions initiated the inclusion of provisions guaranteeing workers a privileged position regarding wage payments during the liquidation of cross-border enterprises, and granting trade unions the right to represent and defend the collective rights and interests of workers in bankruptcy proceedings.
Work on the law began in March 2025. In the course of drafting, the key categories of the document's structure and the types of bankruptcy proceedings were defined. The group also addressed questions of international legal assistance, the recognition of foreign bankruptcy rulings, and the powers of the insolvency administrator appointed in such cases. The concept of the debtor's "centre of main interests" was introduced as a guideline for determining the competent jurisdiction.
Following the discussion and the vote, the participants decided to continue working on the model law.
